Bloomberg: British Columbia sued OpenAI in California, alleging flagged ChatGPT activity should have reached police before Tumbler Ridge shooting.

On Feb. 10 2026, the attack killed 8 victims, including 5 children and an educator, and wounded 27 others.

OpenAI laters said its automated systems detected a ChatGPT account in June 2025, human reviewers examined it, and the company banned it for violating usage rules. But OpenAI did not refer it to police under its rules at the time.
As the activity did not meet its then threshold for “credible and imminent” planning requiring a police referral.

On Feb. 26, 2026, OpenAI explicitly told Canadian officials that it had since made its referral criteria more flexible and added mental-health and behavioural experts to difficult cases, and it wrote: “under our enhanced law enforcement referral protocol, we would refer the account banned in June 2025 to law enforcement if it were discovered today.”
